RESEARCH ROCKSTAR’S TERMS OF USE
Overview: Welcome to Research Rockstar Training & Staffing, Inc. (“Research Rockstar”) and the website of Research Rockstar (“Site”). The following are terms of a legal agreement between you and Research Rockstar (“Terms”). By accessing, browsing, or using this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and to comply with all applicable laws and regulations. If you do not agree to these Terms, please do not use this Site. Your use of the Site and Materials (defined below) is expressly subject to your acceptance of and compliance with the Terms. If you are using this Site on behalf of your employer, you represent and warrant that you are authorized to accept the Terms on your employer’s behalf.
General: Research Rockstar may, in its sole discretion, modify or revise these Terms at any time, and you agree to be bound by such modifications or revisions. You should return to this page from time to time to review these Terms. If you do not accept and abide by these Terms, you may not use the Research Rockstar service. In the event of an inconsistency between these Terms and any other agreement between you and Research Rockstar, the later in time shall control. Your continued use of the Site shall be deemed irrevocable acceptance of all revisions. Research Rockstar reserves the right to change, modify, suspend or discontinue any portion of the Site at any time. Research Rockstar may also impose limits on certain features or restrict your access to parts or the entire Site without notice or liability.
Your Obligations and Conduct: As a registered member of Research Rockstar (”Member”), in consideration of your use of the Site, you agree to: a) provide accurate, current and complete information about you and your company as may be prompted by a registration for the Site (the “Registration Data”); b) maintain the security of your password and identification, if any; c) keep the Registration Data, and any information you provide to Research Rockstar, accurate, current and complete; and d) accept all risks of unauthorized access to information and Registration Data.
If you are a Member, you agree to notify Research Rockstar of any known or suspected unauthorized use(s) of your Account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password. You shall be responsible for maintaining the confidentiality of your password. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your Account, at Research Rockstar’s sole discretion, and you may be reported to appropriate law enforcement agencies.
You agree that you will not use the Site to: a) transmit spam, bulk or unsolicited communications; b) pretend to be Research Rockstar or someone else; c) misrepresent your affiliation with any person or entity; d) disrupt the normal flow of dialogue or otherwise act in a manner that negatively affects other users’ ability to use the Site; e) engage in activities that would violate any fiduciary relationship, and applicable local, state, national or international law, or any regulations having the force of law, including but not limited to attempting to compromise the security of any networks account or site, stalking, or making threats of harm; or f) collect or store personal data about other users unless specifically authorized by Research Rockstar and such users.
Use of Materials: Research Rockstar may provide from time to time materials, tutorials, programs, seminars, software, publications, books and documentation on this Site, some of which may be downloadable or reproducible by you (collectively, the “Materials”). All such Materials including the Site itself is owned solely by Research Rockstar and is its copyrighted work. The Materials may only by used, downloaded, reproduced or disseminated as indicated herein and on the Site. If you do not agree to these Terms and the terms contained elsewhere on the Site, you should not use the Materials. You may not disassemble, decompile, reverse engineer or otherwise attempt to discover the source code of the Materials nor should you use any of the Materials out of context. Some Materials are free and may be downloaded whether or not you are a Member (“Free Materials”). If you chose to use, download, reproduce and/or disseminate any of the free Materials, you must clearly attribute ownership of the Free Materials to Research Rockstar Training & Staffing, Inc. In addition, you must maintain all logos, names, trademarks, service marks and the like (collectively, “Marks”) on the Free Materials exactly as they appear. You may not reproduce and/or disseminate any of the Materials for which a fee is paid. Failure to follow these Terms or any additional terms appearing on the Site, make clear attribution, modify or delete, in any way, the Marks is a breach of your agreement with Research Rockstar and will result in termination of your Account and other appropriate remedies. You agree that you are responsible for your own content creation and communications and for any consequences thereof.
Links: Research Rockstar may provide links to other sites that we feel are relevant and interesting to our users (“Link Sites”). Research Rockstar is not responsible for the content on the Link Sites and is not responsible for the accuracy of the information and intellectual property notices therein. Some of these Link Sites may provide you with opportunities to purchase products (“Products”). We do not endorse any of the Products nor do we make any representations or warranties in connection with the Products.
All links to this Site must be approved in writing by Research Rockstar, except that Research Rockstar consents to links where the link and the pages that are activated by the link do not: a) create frames around any page on this Site or use other techniques that alter in any way the visual presentation or appearance of any content within this Site; b) misrepresent your relationship with Research Rockstar; c) imply that Research Rockstar approves or endorses you, your Website, or your services or product offerings; or d) present false or misleading impressions about Research Rockstar or otherwise damage the goodwill associated with the Research Rockstar and its Materials and Marks. As a further condition to being permitted to link to this Site, you agree that Research Rockstar may at any time, in its sole discretion, terminate permission to link to this Site. In such event, you agree to immediately remove all links to this Site and cease using all of the Materials and Marks.
Submissions: From time to time, certain parts of the Site may ask for written submission, suggestions or problem reports or you may upload or post information or materials (“Submissions”). In such a case, please read carefully the specific terms, if any, which govern those Submissions. In the absence of such specific terms, these Terms shall govern your legal rights with respect to those Submissions. For all Submissions to the Site, you automatically grant Research Rockstar a non-exclusive, royalty-free, perpetual license of all rights throughout the universe to use, edit, modify, include, incorporate, adapt, record and reproduce the Submissions including, without limitation, all trademarks associated therewith, in any manner whatsoever. In addition, you represent and warrant that you are entitled to enter into these Terms and that you waive any so-called “moral rights” in and to the Submissions.
Use of Marks: Research Rockstar’s Marks include the name “Research Rockstar” and “Research Rockstar Training & Staffing, Inc.” and any logos owned and used by Research Rockstar. Research Rockstar takes great care in the development and protection of its Marks and reserves all rights of ownership in its Marks. No one may use the Marks without the express written permission of Research Rockstar. “Fair use” of the Marks, that is, use by a third party without express permission or license, is limited to text-only references to the Marks, and excludes the use of any of Research Rockstar’s logos. In all such references, you must be truthful, must not disparage Research Rockstar, and must not mislead the public. You must be clear and accurate as to the nature of the relationship between Research Rockstar and you, your company, its products, and its services.

Indemnity: You agree to indemnify and hold Research Rockstar, and its subsidiaries, affiliates, owners officers, agents, co-branders or other partners, and employees, harmless from any claim, loss or demand, including reasonable attorneys’ fees, arising out of content your use of the Site, your connection to the Site, your violation of the Terms, your Submissions or your violation of any rights of another person or entity.
Governing Law: This Site is controlled and operated by Research Rockstar. Research Rockstar makes no representation that materials in the Site are appropriate or available for use in your location. Those who choose to access this Site from any location do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. By accessing this Site, you and Research Rockstar agree that these Terms and your relationship with Research Rockstar will be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without giving effect to its conflict of laws principles. Any claims, legal proceeding or litigation arising in connection with the Service will be brought solely in Worcester County, Massachusetts, and you consent to the jurisdiction of such courts.
Copyright: All content, compilation of content, and method of compilation included on the Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and Materials, is the sole and exclusive property of Research Rockstar and is protected by United States and international copyright laws.
